(the "Service"). Please read them carefully.
Member Account, Password, and Security
You must complete the registration process by providing us with current,
complete and accurate information as prompted by the Sign-up Form to
activate your SiteTrafficStats account. Your account is password-protected.
You are entirely responsible for maintaining the confidentiality of
your password and account. Furthermore, you are entirely responsible
for any and all activities that occur under your account.
Users acknowledge and agree that their contact and website information
(personal details, site name, URL, traffic counts, etc.) may be utilized
by SiteTrafficStats.com. Possible uses include (but are not limited
to) a directory of the sites using our service, general informational
and support matters, etc.
At some areas of our website we use industry-standard SSL-encryption
to protect data transmissions.
You agree not to change the SiteTrafficStats.com counter code that
you will insert on your site.
Member Privacy
Maintaining privacy of our members is of paramount importance for
us. SiteTrafficStats will not disseminate, sell or rent your contact
and payment personally identifiable information to any third party
without your prior permission.
We can only disclose your personal information if you consent to the
disclosure or we are compelled or authorized to do so by law.
You agree that SiteTrafficStats may access your account, including
its contents, as stated above or to respond to service or technical
issues.
We retain ownership and all rights to SiteTrafficStats.com logos,
trademarks, software, trade secrets, databases, reports, and Web site.
We both own the data regarding visitors to your website that we collect.
You can use the data we provide for any legal purposes. We will use
the data in compliance with our privacy policy.
Disclaimer of Warranties

You agree to use our services at your own risk. Our services are provided
on an "as is" and "as available" basis. You agree
that you have made your own determination regarding the usefulness
of the service. We disclaim all warranties including, but not limited
to, warranties of merchantability and fitness for a particular purpose.
SiteTrafficStats does not represent or warrant that the Service materials
will be uninterrupted or error-free, that defects will be corrected,
or that this site or the server that makes it available, are free of
viruses or other harmful components.
SiteTrafficStats does not warrant or represent that the use or the
results of the use of the materials available through the Service or
from third parties will be correct, accurate, timely, reliable or otherwise.
You have read our Privacy Policy and Terms of Services and you agree
to them.
Limitation of Liability
We are not liable for damages, direct or consequential, resulting
from your use or inability to use of the service, any failure to provide
service, suspension of service, or termination of service. We do not
guarantee the availability of the service.
You agree not to hold us responsible for data loss or interruption
of service of any kind.
To the fullest extent permitted by applicable law, under no circumstances,
including, but not limited to, negligence, shall Website Tracker be
liable for any direct, indirect, incidental, special or consequential
damages that result from the use of the Service, any changes to the
Service, unauthorized access to or alteration of your transmissions
or data, any material or data sent or received or not sent or received,
or any transactions entered into through the Service.
Indemnification
You entirely agree to defend, indemnify and hold SiteTrafficStats,
its parents, subsidiaries and affiliates, officers and employees, harmless
from and against any and all claims, losses, demand or damage, liability
costs and expenses (including but not limited to attorney's fees) arising
from your violation of this agreement or any third-party's rights,
including but not limited to infringement of any copyright, violation
of any proprietary right and invasion of any privacy rights.
This obligation shall survive any termination of this agreement.
Our liability will not exceed the purchase price of the services.
Termination
SiteTrafficStats or each of our members may terminate his account
and remove his site from our database at any time for any reason including
violations of this Terms of Services.
If you wish to terminate your account, your only recourse is to discontinue
use of the account.
In addition, SiteTrafficStats may terminate your account for inactivity,
which is defined as failing to log into the Service for an extended
period of time, as determined by SiteTrafficStats. You will get an
e-mail notification that your account is going to be deactivated.
If this agreement is terminated by us or by you for any reason, you
agree to remove our code, logos and trademarks from all of your Web
sites and other items.
Modifications to Terms of Service, Member Policies
SiteTrafficStats reserves the right to change these terms and conditions
at any time and to notify you by posting the updated version of the
Terms of Service on our website.
Acceptance
SiteTrafficStats does NOT accept any sites that contain (or link to)
any material that can be categorized as illegal, racist or encouraging
illegal activity and racism or sites that promote or utilize software
or services designed to deliver unsolicited email, or any other objectionable
material as judged by SiteTrafficStats.
SiteTrafficStats reserves the right to delete any account found objectionable.
